Constitutional Safeguards for Backward Classes
The Indian Constitution, recognizing the historical injustices and socio-economic disparities faced by certain sections of society, provides extensive safeguards for 'Backward Classes,' which primarily include Scheduled Castes (SCs), Scheduled Tribes (STs), and Other Backward Classes (OBCs). These provisions aim to promote equality, ensure social justice, and facilitate their upliftment and integration into mainstream society.
I. Social Safeguards:
- Article 17: Abolishes 'Untouchability' and forbids its practice in any form, making its enforcement an offense punishable by law. This is a fundamental right aimed at eradicating a deeply entrenched social evil.
- Article 15: Prohibits discrimination on grounds of religion, race, caste, sex, or place of birth. Crucially, Article 15(4) and 15(5) enable the state to make special provisions for the advancement of any socially and educationally backward classes of citizens or for the Scheduled Castes and the Scheduled Tribes, including reservations in educational institutions.
- Article 23: Prohibits traffic in human beings and forced labor, which historically affected many marginalized communities.
II. Educational Safeguards:
- Article 46: A Directive Principle of State Policy, it mandates the State to promote with special care the educational and economic interests of the weaker sections of the people, and, in particular, of the Scheduled Castes and the Scheduled Tribes, and to protect them from social injustice and all forms of exploitation.
- Article 15(4) & 15(5): As mentioned, these enable reservations for SCs, STs, and OBCs in educational institutions, including private unaided institutions (except minority educational institutions).
III. Economic Safeguards:
- Article 16(4): Empowers the State to make any provision for the reservation of appointments or posts in favor of any backward class of citizens which, in the opinion of the State, is not adequately represented in the services under the State.
- Article 16(4A) & 16(4B): Provide for reservation in matters of promotion with consequential seniority and carrying forward of unfilled vacancies for SCs and STs.
- Article 46: Also emphasizes promoting the economic interests of these weaker sections.
IV. Political Safeguards:
- Article 330 & 332: Provide for the reservation of seats for Scheduled Castes and Scheduled Tribes in the Lok Sabha (House of the People) and the Legislative Assemblies of the States, respectively, ensuring their representation in national and state legislatures.
- Article 243D & 243T: Mandate reservation of seats for SCs and STs in Panchayats (rural local bodies) and Municipalities (urban local bodies), respectively, including reservation for women from these categories.
V. Administrative and Institutional Safeguards:
- Article 338: Establishes the National Commission for Scheduled Castes (NCSC) to investigate and monitor all matters relating to the safeguards provided for SCs under the Constitution.
- Article 338A: Establishes the National Commission for Scheduled Tribes (NCST) with similar functions for STs.
- Article 338B: Establishes the National Commission for Backward Classes (NCBC) to examine complaints and welfare measures for OBCs.
- Article 335: States that the claims of SCs and STs shall be taken into consideration, consistently with the maintenance of efficiency of administration, in the making of appointments to services and posts in connection with the affairs of the Union or of a State.
These constitutional provisions collectively form a robust framework designed to address historical disadvantages, ensure equitable opportunities, and foster the overall development and empowerment of Backward Classes in India.
